My client was merely trying to utilize gym equipment in a reasonable manner. Waiting for 40 minutes is excessive, and the teenagers were clearly monopolizing the machine without actively using it. It's understandable that my client took initiative, since they were being inconsiderate of other gym members.
The plaintiff exhibited impatience and a sense of entitlement. Instead of escalating the situation by confronting the teenagers directly, a more appropriate approach would have been to immediately seek staff intervention. The plaintiff's actions disrupted the gym's atmosphere and created unnecessary conflict.
While the teenagers were indeed inconsiderate in their use of the hip thrust station, the plaintiff could have handled the situation more diplomatically by involving gym staff from the outset. Confronting the teenagers directly, while understandable, contributed to an escalation of the conflict. Therefore, the plaintiff bears some responsibility for the way the situation unfolded. However, the teenagers should have been more considerate of other gym users. It is a public facility and equipment hogging is frowned upon.
